1. General Provisions
The present conditions are valid between the company that owns the domain store.plus-fishing.com hereinafter referred to as “ASCENSUS PROPAGANDA INTERNATIONAL SRL” and any person who makes purchases online on store.plus-fishing.com hereinafter referred to as “CUSTOMER”. These conditions can be subject to amendments, the date when they are placed online is equivalent to the date they come in force.
2. Object of the Contract
With the present general sales conditions, ASCENSUS sells and the customer purchases remotely the goods indicated and offered for sale on the store.plus-fishing.com website. The contract is concluded exclusively by means of internet, with the CUSTOMER accessing the store.plus-fishing.com website and placing a purchase order according to the procedure indicated by the website itself.
3 Conclusion and effectiveness of the contract
3-1 The sale shall be considered concluded when ASCENSUS forwards an order confirmation e-mail. The e-mail contains the CUSTOMER and order data, the price of the purchased goods, the shipping and accessory costs and the shipping address the goods will be sent to. The CUSTOMER undertakes to check the correctness of the contained data and gives prompts communication of any corrections.
3-2 ASCENSUS undertakes to describe and present the articles sold on the website in the best possible way.
4 Product availability
Plus Fishing is a European distributor with several sales channels including an online store.
Product availability is updated daily. In case of partial or total unavailability of the products offered for sale, the customer will be promptly informed in order to decide whether:
- accept delivery of only available products and:
- change or partially modify the order;
- wait for the availability of missing products by agreeing on delivery time;
- request a refund of the total amount value of the missing products;
- request cancellation of the order.
5 Payment Methods
5-1 Each payment the CUSTOMER makes will be exclusively by means of one of the methods indicated on the store.plus-fishing.com website. For payments made by means of credit card/Paypal, if the product is found to be unavailable after he order has been recorded and the cash booked on the card, ASCENSUS will take the necessary measures with the payment operator to write off the transaction relating to the unavailable goods. The order amount will be charged only when this is complete and ready for shipping.
5-2 The communications related to the payment and the data communicated by the CUSTOMER when the payment is made are carried out by means of protected lines with all guarantees ensured by making use of the safety protocols applied by the payment circuits.
6 Prices
6-1 All sales prices of the products displayed and indicated on the store.plus-fishing.com website are in Euros and include VAT.
6-2 The shipping costs are included in the purchase price, but are indicated and calculated when the purchase process is concluded before making the payment.
6-3 The CUSTOMER accepts the faculty of ASCENSUS to modify its prices at any time, anyhow the goods shall be invoiced according to the prices indicated on the website when the order was made and confirmed in the e-mail sent by ASCENSUS as confirmation of the order acquisition.
7. Compliance guarantee
In case of the reception of products not conforming to the order or with defects, the CUSTOMER will have to communicate it by e-mail to the customer service within the term of 14 days from the date of reception of the goods. In the e-mail the CUSTOMER must specify if he/she wants the article replaced or a refund. The replacement can be made exclusively with an article of the same model, colour and size of the one/s returned. ASCENSUS shall take care of contacting the courier who, compatibly with his availability, will collect the goods. ASCENSUS reserves the faculty to check the contested non-conformity and in case of an affirmative result will send the replacement goods or make the refund by crediting the card used by the customer to make the purchase.
8. Warranty on products
All products presented on the store.plus-fishing.com website benefit from a contractual warranty with a duration indicated on the article product sheets and in any case are covered by a legal warranty of 24 months for conformity defects according to the legislation in force. To benefit from in-warranty services, the CUSTOMER must keep the invoice received by e-mail at the moment the order was sent.
9. Conditions of delivery
9.1 The products will be delivered by express courier to the address indicated by the CUSTOMER when placing the order.
9.2 For each order placed on the website ASCENSUS issues an invoice for the shipped material, sending it by e-mail following the order fulfilment. The invoice is issued referring to the data provided by the CUSTOMER during the purchase procedure. After issuing the invoice, it will not be possible to make any amendments to its data.
10. Responsibility
10.1 ASCENSUS shall not be held responsible for disservices attributable to force majeure or fortuitous events, even when caused by malfunctions and disservices of the internet network, in case it would not be able to fulfil the order within the terms set by the contract.
10.2 The availability of each article is purely indicative, does not have a contractual character and the seller cannot be considered responsible in case of the unavailability of one or more products.
11. Access to the website
The CUSTOMER has the right to access the website for consultation and to make purchases. No other use of the website and its contents is allowed, in particular those of a commercial nature. The integrity of the elements of this website, whether they are visual or sound effects, and the respective technology employed remain property of ASCENSUS and are protected by Intellectual Property Rights.
12. Integrity
The present General Terms of Sale consist of all the clauses that form them. If one or more provisions of the present General Terms of Sale is considered non valid or declared such according to the law, regulations or following a resolution by a competent court, the other provisions shall continue being in force and shall have full effectiveness.
13. Applicable law and competent court
The present General Terms of Sale are subject to Italian Law. Whatsoever dispute that shall not find a friendly settlement shall be subject to the exclusive competence of the Court of Velletri.
